South Carolina, like most states, requires by law a minimum amount of liability coverage for every driver on the road. But, like most laws, for every person obeying them there is another who is breaking them. An estimated ten percent of all drivers in South Carolina do not have any insurance at all. South Carolina was ranked third in the country at one point in terms of percentage of insured drivers on the road, but that number has steadily declined.
A newer study shows that the recession has affected this further and the number of uninsured drivers is steadily rising among all states. South Carolina has been hit hard by the recession, and our practice is finding that more drivers are driving without insurance and causing accidents every day.
What happens when you are hit by an uninsured driver? Unfortunately, more often than not the driver who is without insurance is without recoverable assets in a civil action against him or her. Fortunately, most states, including South Carolina, require a minimum amount of uninsured motorist insurance for the insured driver to protect against an uninsured motorist. This coverage is not for the benefit of the uninsured driver, but rather, for the benefit of the insured driver. The mandatory uninsured motorist or UM coverage is $10,000, but an insurer may offer, at the insured’s election, up to the amount of the liability policy.
