Supreme Court Rules on Arizona Law | Charleston Immigration Lawyers

The United States Supreme Court issued its opinion today, June 25, 2012 in the landmark immigration case Arizona et al. v. United States.  The Court overruled the following major portions of Arizona law SB1070: (1) requiring aliens carry registration papers on their person; (2) barring illegal aliens seeking employment; and (3) allowing police to stop and arrest those persons they believe to be present in the United States illegally (based solely on this belief).  However, the Supreme Court upheld the requirement that police attempt to ascertain the immigration status of persons they arrest if there is “reasonable suspicion” that the person is in the United States illegally.  This portion of the law was upheld on procedural grounds and was essentially punted for future review.
